With the traditional service stream, each party engages their own lawyer to advise and represent them on child support matters. Child support in Australia is primarily administered by Services Australia under a formula-based assessment, but disputes often arise about the assessment itself or arrangements that fall outside the formula.
Your lawyer can assist you to apply for a change of assessment where special circumstances exist, object to a decision, or seek a review. Where parties cannot agree, the matter may proceed to the Administrative Appeals Tribunal or, for binding child support agreements and departure applications, to the Federal Circuit and Family Court of Australia.
This pathway is adversarial in nature — each party's lawyer advocates for their client's position, and an independent decision-maker determines the outcome where agreement cannot be reached.
